1. Services

FirstPixel provides design services on a monthly subscription basis. This includes graphic design, branding, logo design, UX/UI design, landing page design, pitch deck design, social media design, and other visual design work as described on our website. We deliver design only — no code, development, or implementation is included unless explicitly agreed upon.

2. Subscription and Payment

Subscriptions are billed monthly in United States Dollars (USD) at the rate listed on our website. Your billing cycle begins on the date of your first payment and renews automatically each month unless canceled. Payments are processed through our third-party payment processor. By providing your payment information, you authorize us to charge the applicable fees. We reserve the right to change pricing with at least 30 days' notice before the next billing cycle.

3. How It Works

You may submit unlimited design requests, which are worked on one at a time in the order received. We aim to deliver initial designs within 1–5 business days depending on complexity. Revisions are unlimited until you are satisfied. We do not guarantee a specific number of completed requests per month, as turnaround depends on the scope and complexity of each request.

4. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No further charges will be made after cancellation takes effect. You may also request to pause your subscription for up to one billing cycle before your next billing date.

5. Refund Policy

Due to the nature of our services, all subscription payments are non-refundable. We do not offer refunds for partial or unused subscription periods. If you are dissatisfied with our Service, please contact us and we will make reasonable efforts to resolve your concerns. If you cancel within the first 7 days of your initial subscription and no design work has been delivered, you may request a full refund by contacting us at marcel@firstpixel.co.

6. Intellectual Property

Upon full payment for the applicable billing period, you own all rights to the final delivered design files. We retain the right to showcase completed work in our portfolio unless you request otherwise in writing. You are responsible for ensuring that any content, images, or materials you provide to us do not infringe on third-party intellectual property rights.

7. Confidentiality

We treat all client information, briefs, and materials as confidential. We will not share, sell, or disclose your information to third parties, except as necessary to deliver the Service (e.g., sharing briefs with our design team) or as required by law. Our designers and contractors are bound by confidentiality agreements.

8. Limitation of Liability

FirstPixel's total liability for any claim arising from the Service is limited to the amount you paid in the most recent billing period. We are not liable for any indirect, incidental, or consequential damages, including lost profits, revenue, or data. Our services are provided "as is" without warranties of any kind, express or implied.

9. Privacy Policy

Information We Collect. We collect the information you provide when subscribing, including your name, email address, company name, and payment details. We also collect project-related information such as design briefs, brand assets, and feedback you share with us.

How We Use Your Information. We use your information solely to provide and improve our Service, process payments, communicate with you about your projects, and send service-related updates. We do not sell your personal information to third parties.

Payment Data. Payment information is processed and stored by our third-party payment processor. We do not store credit card numbers or banking details on our servers.

Cookies. Our website may use cookies to improve your browsing experience and analyze site traffic. You may disable cookies in your browser settings.

Data Retention. We retain your account information and project files for as long as your account is active and for a reasonable period afterward. You may request deletion of your data by contacting us at marcel@firstpixel.co.

Your Rights. You may request access to, correction of, or deletion of your personal data at any time by emailing us. We will respond to your request within 30 days.

10. Termination

We reserve the right to suspend or terminate your subscription if you violate these Terms, engage in abusive behavior toward our team, or use our Service for unlawful purposes. In case of termination by us, you will receive a prorated refund for the unused portion of your billing period.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes via email or through our website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms will be resolved in the courts of Itajaí, Santa Catarina, Brazil.
